Considering:

- the decision No. 734 taken by the Permanent Council of the OSCE on 30 June 2006, concerning the establishment of the OSCE Project Co-ordinator in Uzbekistan (hereinafter referred to as ?the Co-ordinator?), with a view to the further development and consolidation of project activities of the OSCE in Uzbekistan;

- the tasks of the Co-ordinator in Uzbekistan provided by the above-mentioned decision;

- the agreement of the Government of the Republic of Uzbekistan (hereinafter referred to as ?the Government?) to host the office of this Co-ordinator, to facilitate its work and cooperate with it;

- the respect for all OSCE principles as the basis for close cooperation between the Government and the OSCE;

The Secretary General of the OSCE and the Government have agreed on the following:

Article I

The Government will facilitate the work of the OSCE Project Co-ordinator and its office in Uzbekistan.

Article II

The tasks of the Co-ordinator are those defined by the above-mentioned decision of the Permanent Council of the OSCE of June 30, 2006. In carrying out its functions, the Co-ordinator and its staff will respect the laws of the Republic of Uzbekistan.

Article III

The Government shall accord the Co-ordinator and the office?s staff, the legal status, privileges and immunities as set forth the decision of the CSCE Council of Ministers of 1 December 1993 concerning the legal capacity of the CSCE Institutions and Privileges and Immunities (document CSCE/4-C/Dec.2, Annex 1).

Article IV

The post of the Co-ordinator shall be established for a period of six months, beginning on 1 July 2006. Extensions of this period shall require the agreement of the Parties, in accordance with the existing practice. The office shall consist of the Co-ordinator, international staff (2), 3 national professionals from among the citizens of the Republic of Uzbekistan, and technical personnel, hired as required by the tasks established by the mandate. For the implementation of the jointly developed annual plan of programmes and projects, additional staff will be hired.

Article V

The office of the Co-ordinator shall be located in the same premises as the OSCE Centre in Tashkent.

Article VI

The Co-ordinator and its staff can establish and maintain contacts with Governmental institutions, as well as with other relevant entities, in order to perform the tasks entrusted to the Co-ordinator by its mandate. In the preparation and implementation of OSCE projects, the Co-ordinator and its staff will act in close co-operation with the ?Fund of Support to Non-Governmental and Non-Commercial Organizations of Uzbekistan?, as well as with officially registered non-governmental and non-commercial organizations. This will be done in accordance with the legislation of the Republic of Uzbekistan.

Article VII

The staff of the Co-ordinator?s office shall refrain from any activities that are incompatible with the impartial nature of their duties.

Article VIII

Any disputes concerning the interpretation or application of this Memorandum shall be the subject of consultations between the OSCE (represented by the Secretary General) and the Government with the aim of reaching an agreed settlement.
